Facts
of the Case:
The Hon'ble Commision by its Order dated 5.5.2000 has directed
MSEB to provide the data related to FCA every quarter. The Commission
has also directed that FCA should not be charged by MSEB without
prior approval of the Commission and that the Commission would
prescribe a methodology for charging the FCA. Accordingly, MSEB
has not charged any FCA in the tariff during 2000-01 so far. |

Submission
in support of the case: |
| 1. |
Section
22 of Chapter V of the Electricity Regulatory Commission Act,
1998 states that the State Commission shall discahrge the function
of determining the tariff for electricity, wholesale,bulk,grid
or retail as the case may be. |

For
the year 2000-01 up to the month of December 2000, the Board
has estimated that the total incremental Fuel and Other costs
that need to be recovered from all its consumer is Rs. 651.36
crore. |

It
is therefore sumbitted to the Hon'ble Commission that, in view
of the estimated incremental costs as above, the Board proposes
to recover such incremental costs from time to time from all
its consumers through Fuel and Other Cost Adjustment (FOCA).
A generalised formula for computation of FOCA is submitted.
A proposal to that effect is annexed hereto for consideration
& approval of the Hon'ble Commission. |

is therefore requested that: |

The
Hon'ble Commission may please approve the proposal formula for
computation of FOCA from time to time. |
| 2. |
The
Hon'ble Commissin may please approve & authorise MSEB for
billing and recovery of the said incremental costs through such
approved formula. |
