The clause regarding arbitration has been deleted
by the Board from the H.T. agreement as provision
for arbitration exists in the indian Electricity Act
1910. In line with this policy it has been decided
to amend clause 15 of the street lighting agreement.
The revised clause shall read as follows:
"Either party hereto may determine this Agreement
at the end of a period of seven years from__________day
of____19___ or at the end of every subsequent period
of one year by giving to the other three months previous
notice in writing or his intention so to do and the
expiration of such notice this agreement shall cease
and determine.".
All the street lighting agreements which may be executed
hereafter should provide clause 15 as amended. As
regards the existing street lighting agreementswith
the Municipalities/ Village Panchayats, on expiry
of the initial period of 7 years or thereafter, their
agreements may be terminated after giving due notice
as provided in the agreement already executed and
fresh agreements may be executed with them in the
agreement form as amended upto - date including the
above mentioned amended clause 15.
It is requested that action may be taken well in time
to see that all the street lighting agreements are
brought upto the up-to- date standard from of the
