Sub  : Electricity duty- payment of..Instructions to local Bodies.


Sir, 

I am directed to invite your attention to your letter. No. 26/218/60-NB,dated 10th June 1963 (Copy enclosed for ready reference) wherein it was stated that instructions were issued to all offices under your Department as requested in this Department's letter No. ELD-1 261/93823-Elec. 1, dated the 27th February 1962 to get separate meters installed with a view to measuring the quantum of electricity consumed for off ice purposes to facilitate exemption from payment of electricity duty:. Instances have come to the notice of this Government where separate meters have still not been installed by many post offices, with the result that orders are required to be issued by this Government to refund the electricity duty on the consumption of electricity for office purposes. The Bombay Electricity Duty Act, 1958 has been amended and slabs in rates of electricity duty have been laid down. With the introduction of this slab-system, it has become difficult to assess electricity duty if a particular part of the consumption is to be excluded from the working. It may even result in loss of revenue to the State Government. As already observed in this Department letter No. ELD-1 261/92823- Elec.1 dated the 27th February 1962, a consumer should have the meter in his own name to be eligible for any exemption from payment of all electricity duty. Otherwise if the meter is in the name of the Landlord, the Government of India, and this Government would be within its right to reject any claims for refund of electricity duty. 

2. In the circumstances, suitable instructions may be issued by you to all the post offices situated in rented premises to have separate meters for electricity consumption, if not already done. 

3. The Maharashtra State Electricity Board is being requested not to accept in future any certificates mentioned in its Circular NO.58 issued under No. PG-32/44251 dated the 12th September 1961.
