(Form No. 1-5) AGREEMENT FOR TEMPORARY SUPPLY AT H.T. FOR CONSTRUCTION OF PROJECTS (WHEN SUPPLY TO BE DISCONNECTED ON COMPLE- TION OF THE PROJECT)
   
   

AN AGREEMENT made at the day of ................ 19..... BETWEEN THE MAHARASHTRA STATE ELECRICITY BOARD (Hereinafter calld "the supplier" wherever the context so admits shall include his successors and assigns of the one part AND (hreinafter called'' the consurneer, which expression, wherever the context so admits, shall include his heirs, executors, administrators/its successor or successors in business and permitted as- signs) of the other part.

WHEREAS at the raquest of the Consumer the Supplier has agreed to supply to the Consumer electrical energy for the purpose of at the Consumer's premises situated at upon the terms and subject to the conditions hereinafter contained.

NOW THIS AGREEMENT WITNESSETH as follows:

Definition 1) In this agreement unless the context otherwise re- quires:
     
  a) "the ACT" shall mean the Indian Electricity Act, 1910 as amended from time to time or such other enactment governing the supply and use of electrical energy as may be in force from time to time:
     
  b) ''the Rules" shall mean the rules and regulations for the time being in force from time to time under the Act.
     
  2(a) The work for giving supply would be takenup only after the consumer deposits the full amount of the estimated cost of the work which would be intimated to the consumer by the Executive Engineer, within a period of three months from the date of intimation from the Chief Engineer, Maharashtra State Electricity Board (hereinafter referred to as "The Chief Engineer" which expression shall include any other Off icer authorisedd by the Supplier to perform the functions of the Chief Engineer specified in this agreement and any ohter Off icer or Off icers authorised by the Chief Engr.) that the Board is in a positions to commence supply and to make electrical endergy available, the consumer shall commence to take suppply of electrical enefgy under this agreement and the date of commencement of supply should be the date of expiration of the saik three months period or the date of actual commencement of supply, whichever date is earlier, and from such date the consumer shall becomce liable to pay the supplier the amount of minimum bill under the tariff applicable unless in the opinion of the Chief Engineer the consumer is unable to commence to take supply for causes beyond his control in which event the date of commencement of supply may be extended by the Chief Engineer at his absolute discretion by a period not exceeding six months.
