         A G R E E M E N T

     This Agreement made at                        the day of                 19                             BETWEEN THE MAHARASHTRA STATE ELECTRICITY BOARD hereinafter celled "the Board" (which expression shall, unless the context does not so admit, include successors and assigns) of one part and under the firm name and style of M/s.__________________________ hereinafter called "the Consumer" (Which expression shall, unless the context do not so admit include his heirs, executors and administrators)                                                       of the other part:

     WHEREAS the consumer has requested the Board to extend certain concessions in the matter of payment of outstanding energy charges so as to enable the consumer to revive the operational activities of his industrial Unit at                       and to allow the consumer to pay the amount of arrears so reduced as a result of granting the said concession by equal monthly instalments which the Board has agreed to do in the manner and upon the terms and conditions hereinafter contained:-

      NOW THIS AGREEMENT WITNESSETH AS FOLLOWS:

1)    The consumer acknowledges that there is now dues and payable by the consumer to the Board the sum of Rs.(Rs.                               ) as the arrears of bills in respect of energy supplied by the Board to the consumer for and during the period from                     to_______

2)   In order to enable the Consumer to revive the operational activities of the said industrial unit the Board agrees to accept a sum of Rs            (Rs.                       ) in full settlement of the amount of the said arrears by monthly instalment of Rs..                       .The first instalment to be paid on or before the.                       day of each succeeding month thereafter.

3)   If the consumer commits any default in payment of any monthly instalment on its due date the entire amount of unpaid arrears of the original amount of Rs.                  will become due and payable forthwith and the consumer shall pay to the Board interest thereon at 80%/24% per annum thereon from the date of default until payment and shall also be liable to be disconnected.

4)  The Consumer shall pay the above monthly instalments, alongwith current energy bills, regularly, as herein above, provided.

5)  The concessions granted under this Agreement shall be personal to the Consumer and in the event of any sale or transfer by the Consumer of his said industrial unit the Board will be entitled to recover from the consumer the original amount of Rs.                  less the amount of instalments paid by the consumer.

6)  Save as otherwise expressly provided in this Agreement, the original Agreement dated the                    19         between the Board and Consumer for the supply of Electrical Energy at the Consumer's premises shall remain in full force.

7)  The Consumer hereby agrees to bear the stamp duty on this agreement and its duplicate.
