power supply to a group of shops selling fire crackers..

A
case was forwarded by Superintending Engineer (NSKC),
Nasik, seeking permission to give temporary supply
to a single contractor who will arrange to supply
electricity to individual shop owners, who sell fire-crackers
during Diwall season.
The Board
vide its Resolution 1770 dt. 12.6.79 accorded it's
post- facto approval to the above case and decided
as follows:
Common
connection to a single agency/consumer can be given,
provided he furnishes an undertaking that he shall
not engage in the business of supply energy, but merely
share electricity supplied by the Board with a specified
No. of Fire Cracker Stall owners and will not earn
any profit in the process. It is essential that an
undertaking to this effect is obtained from such consumer
in orderto satisfy the provision of section 28 of
I.E.Act., 1910 as well as condition 24 of the Board's
standard "Conditions & Miscellaneous Charges."
As per
our conditions of supply, initially such temporary
supply may be given for a period not exceeding one
month but the supply can be extended for further periods
not exceeding one month on each occasion.
In this
connection the Board has also resolved that the powers
to decide such cases in future be delegated to the
Chairman, provided that such temporary supply of energy
should be for a maximum period of 3 months only. This
restriction shall apply to the present case also.
