It
has been brought to the notice of this office, by
the various field offices, that there is a persistant
demand from many Local Bodies like Municipal Councils,
Grampanchayats that, M.S.E.B. should pay the rental
charges for poles, towers etc, erected by the Board
in their areas.
This
issue was therefore examined from the legal point
of view and it is observed that, the Local bodies
are empowered to do so as per provisions of Mharashtra
Municipal Act. 1965.
As
this is the additional burden to the Board, it was
felt necessary to revise the street light tariff to
account for the additional burden on account of such
levy of rental charges. The Board therefore vide B.R.
No. 338 dt.23.1.80, has approved the addition of the
following clause to the street light tariff schedule'A'.
(e) "If
any local body charges rental charges for poles, towers,
stays, etc. erected in their areas, then the same
would be recovered by the Board from the concerned
local body by way of a surcharge equivalent to the
said monthly rental amount in the monthly Street Light
Bill itself".
The above
addition will come in force w.e.f. the date of B.R.I.e.
23.1.80. All the field officers are requested to address
to communicate the revised street light Tariff schedule
to all Local bodies who have started levying such
rental charges.
A seperate
Public Notice is also being issued from this end.
It
may also be noted that Revenue Deptt. of the State
Govt. are insisting N.A. Assessment charges for the
Govt. Land on which poles, towers, etc. have been
erected by the Board. This matter has been taken-up
by this office with the State Govt. requesting to
issue necessary instructions to the District
collectors,
in the State not to levy such N.A. assessment charges.
Govt's decision in the matter will be notified to
all field officers, as soon as the same received.
