Adjustment
of Security Deposit against arrears.

It
is observed that when some sick industrial units are taken
over by the N.T.C. or any other Government undertaking
the assets and liabilities of the consumer are also taken
over by them and liabilities of the consumer are cleared
by them through the Registrar of payments or Court Receiver
appointed by them on the basis of the priorities prescribed
by this Act. The amounts thus available are barely sufficient
to meet the liabilities of the creditors whose priorities
are higher than ours. Therefore, on the one hand we have
to handover S.D. collected by us if shown as an asset
of the consumer and on the other hand we may not stand
a chance of recovering our dues for power supply.
Therefore,
when the consumer is in arrears and has not made efforts
to clear our dues even after temporary disconnection for
a long time and if they are likely to be taken over by
Central or State Government for management under Sick
Textile Relief Undertaking Act or Industrial Development
Regulation Act or any other Act, then we should take immediate
action to adjust the security deposit of the consumer
against their arrears immediately before the actual taking
over is effected or before they are declared sick under
Relief Act and amnesty granted by Governments against
recovery of arrears.
All
concerned are requested to take suitable action accordingly
and inform the consumer suitably as also adjust our books.
