DEPARTMENTAL CIRCULAR (COMMERCIAL) NO. 674

Subject:           Determination of Billing Demand in respect of High Tension & Low Tension consumers ---- Clarification thereof.

                Immediate attention is invited to the letter no. PR – 3 / Tariff / 3975 dated 06/02/2003. It is once again to inform all the concerned that:

a)                  The demand recorded during 2200 hrs to 0600 hrs by a High Tension consumer as well as Low Tension consumer who has opted for LT MD tariff, irrespective of whether the same exceeds his Contract Demand or otherwise, will be ignored for determination of Billing Demand,

b)                  However, the consumer exceeding Contract Demand shall be billed penalty as per the prevailing provisions i. e. at the rate of 50% of the prevailing Demand Charges and such penalty will be charged only on the Demand in excess of the Contract Demand,

c)                  Further, the consumers exceeding Contract Demand shall also be liable to pay the SLC as per the provisions of Condition No. 31 (f) (i).

Now, the Hon’ble Commission by its Order dated 04/02/2003, has inter – alia further directed that:

(I)                  The guidelines / instructions as above will be with effect from 01/05/2000 i. e. the effective day of the first tariff Order passed by the Hon’ble Commission,

(II)                All such pending disputes / appeals in respect of determination of Billing Demand on the basis of the Demand recorded during night hours will be settled and refund, if any, will be given to the consumer, without interest, provided the same are cleared before 31/03/2003.

            All the concerned Field Officers should therefore note the further guidelines / instructions as above and should ensure that all pending disputes / appeals in respect of determination of Billing Demand are settled within the prescribed time limit.
